Appeal from a decision disallowing
appellants’ limitation defence. Appellant
D Ltd. owed respondent, a bankrupt,
money secured by a 1996 promissory
note. Respondent’s trustee in bankruptcy
commenced an action in 2006 for payment of the promissory note, two years
after the trustee had become aware of the
note. Appellants pleaded the limitation
defence to the action. The chambers
judge found that there was no inordinate
delay by the trustee starting the action
and that any deleterious impact of the
passage of time on the evidence was lessened, because it had been preserved in
the course of prior litigation. The judge
concluded that appellants would not suffer prejudice if their limitation defence
was disallowed.
HELD: Appeal dismissed. The cham-
bers judge did not err in finding that
there was no inordinate delay and that
the action was commenced on a timely
basis. Of no consequence was the fact
that the judge did not consider in his
reasons the trustee’s explanation of why
it took him two years to start the action.
Appellants’ only prejudice, that they now
had to proceed to trial on the debt issue,
was not to be given much weight in bal-
ancing prejudice under the Limitation
of Actions Act (N.S.).
MUNICIPAL LAW
BYLAWS – A City bylaw prohibiting
the erection of temporary shelters in
public parks during the day did not
infringe a homeless person’s s. 7 Charter rights.
Appeal from the dismissal of an appli-
cation to set aside summary convictions
under a bylaw of respondent City pro-
hibiting daytime erection of temporary
shelters. In a prior proceeding, the court
had declared that the City bylaw in its
original form was unenforceable to the
extent that it prohibited temporary
structures at night. The City subse-
quently amended the bylaw to prohibit
the erection of temporary shelters in
public parks during daytime hours.
Appellant was convicted under the
amended bylaw. At trial and on appeal to
the Supreme Court, appellant took the
position that the homeless were unable
to sleep at night and thus required tem-
porary shelters on public land during the
daytime. Appellant relied on s. 7 of the
Charter. The trial judge rejected the
Charter defence. The judge found that
the previous decision related to the plight
of the homeless in nighttime conditions
when insufficient shelter beds were avail-
able. The judge found no factual basis in
the evidence for the argument that the
decision should be extended to daytime
hours. The judge ruled that the amended
bylaw was a reasonable restriction under
s. 1 of the Charter. The daytime limita-
tion was a minimal impairment of appel-
lant’s Charter rights and was reasonable
and justified, having regard to the public
interest. The convictions under the bylaw
were affirmed.
