Mentoring work as part of continuing professional development
(CPD) requirements is not being
used as much as it could be, Law
Society of B.C. benchers heard
Sept. 9 as they accepted 15 CPD
recommendations.
“We have about 80 mentor
relationships now approved,” said
director of education and practice
Alan Treleaven. “Our goal is to
decrease lawyer isolation.”
“It’s not used as much as we
would like,” said the Lawyer Edu-
cation Advisory Committee chair
Thelma O’Grady.
With new guidelines adopted
by benchers and effective Jan. 1,
2012, mentoring credit is available
for mentoring another lawyer or
an articling student, but not for an
articling principal mentoring one’s
own articling student. Credit is
available for six hours spent with a
mentee.
Among other issues presented
to benchers for approval in CPD
were the number of hours needed,
reporting, writing credits, self
study and overall subject matter.
“The purpose of continuing
professional development is to
energize lawyers to study in areas
of practice,” society president
Gavin Hume said.
The requirement of 12 hours
per year of CPD will continue,
with two hours of that being any
combination of professional
responsibility and ethics, practice
management and client care and
relations. Overall subject matter
should include substantive law,
procedural law, professional ethics, practice management (
including client care and relations) and
lawyering skills.
Bencher David Crossin said he
was disappointed to see that pro
bono work was not included as
something for CPD credit. He said
while pro bono work may not fall
under a classical understanding of
ethics for lawyers, it could be
something that falls within under-
standing ethics.
“Credit is available
for six hours spent
with a mentee.
Credit for courses will be based
on actual time in attendance;
online real-time courses, stream-
ing video, webcast and teleconfer-
ence courses if there is an oppor-
tunity for lawyers to ask and
receive answers to questions; local
or county Bar association educa-
tional programs and Canadian Bar
Association section meetings; and
reviewing a previously recorded
course, if at least two lawyers
review it together, including by
telephone or other real-time com-
munications technology.
