A Treasury Board spokes-
person declined to say whether
the government will appeal. “We
are currently reviewing the deci-
sion carefully and will deter-
mine the appropriate course of
action,” Anabel Lindblad told
The Lawyers Weekly. “As such,
further comment at this time
would be inappropriate.”
The AJC’s president Marco
Mendicino, a Toronto prosecu-
tor on leave from the Public
Prosecution Service of Canada,
said the decision comes as a
relief for his membership.

“Treasury Board can no
longer attempt to clawback
more than a year of overtime
paid out to federal lawyers,
which it said it would consider
doing if it was successful before
Federal Court,” he told The
Lawyers Weekly. “The threat of
a clawback created a furor
because the employer had for
eight months authorized over-
time payments without warning
federal lawyers that they could
later lose that compensation.”
The AJC was certified as the
bargaining agent for federal
lawyers in 2006 but did not sign
its first collective agreement
until July 27, 2010.
